The Service and its original content, features, and functionality are the exclusive property of digital cuisine GmbH & Co. KG and its licensors. The Service is protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works of the Service without our prior written consent.

5. Third-Party Services

The Service may integrate with third-party services (e.g. Uptime Kuma, Google Analytics). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

6. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claims arising from these terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or 100 EUR if you have not paid anything.

8. Termination

We may terminate or suspend your account at any time, without prior notice, for breach of these terms or for any other reason. Upon termination, your right to use the Service ceases immediately. You may stop using the Service at any time by discontinuing use and, where applicable, closing your account.

9. Governing Law and Disputes

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of performance is Hannover. If permissible, the parties agree Hannover as the place of jurisdiction.

If you have a concern about the Service, please contact us first to try to resolve it informally. EU consumers may benefit from mandatory provisions of the law of their country of residence.

10. Changes

We may modify these terms at any time. For material changes, we will make reasonable efforts to provide at least 30 days' notice before the new terms take effect. By continuing to use the Service after changes become effective, you agree to the revised terms. If you do not agree, please stop using the Service.

11. Severability

If any provision of these terms is held to be unenforceable, the remaining provisions will continue in full force and effect.
